Manila, Philippines – Ibinasura ng Kataas-taasang Hukuman ang petisyon ng isang abugado na nagtatanggal sa legal barrier sa same-sex marriage sa Pilipinas, kahit na nakasaad sa Konstitusyon na hindi hinihigpitan ang kasal sa basehan lamang ng kasarian.

Matatandaang pinadedeklara ni Jesus Falcis III noong 2015 bilang unconstitutional sa probisyon ng Family Code na nag-lilimita sa kasalan sa pag-iisa sa gitna ng lalaki at babae lang.

Kasama sa mga probisyon ng Family Code na kinukwestsyon ni Falcis sa SC ay ang mga:

a.) Art. 1 defining marriage as “a special contract of permanent union between a man and a woman,”;

b.) Art. 2 which enumerates the essential requisites of a valid marriage to include the “legal capacity of the contracting parties who must be a male and a female”

c.) Art. 46. identifying the concealment of homosexuality or lesbianism, among other things existing at the time of the marriage as fraud which may be used as basis for the annulment of a marriage; at;

d.) Art. 55. identifying lesbianism or homosexuality as grounds for a petition for legal separation.

Kahit na sinabi ng korte na ang 1987 Constitution mula sa “plain text” na “does not define, or restrict, marriage on the basis of sex, gender, sexual orientation, or gender identity or expression,” binasura pa rin ng husgado ang petisyon ni Falcis.

Ayon naman kay Supreme Court Public Information Office chief Brian Keith Hosaka sa isang press briefing na binasura ng court en banc ‘unanimously’ ang petisyon ni Falcis dahil sa ‘lack of legal standing to initiate the petition as well as for failing to comply with the principle of hierarchy of courts.’

Ayon sa korte na kahit hindi nililimitahan ng Constitution ang pagpapakasal sa basis of gender, kailangan pa rin ng formal legislation para masiguro ang mas maayos na deliberasyon sa pagtiyak sa mga karapatan.

“Adjudication assures arguments between parties with respect to the existence and interpretation of fundamental freedoms. On the other hand, legislation ideally allows democratic deliberation on the various ways to assure those fundamental rights,”

“The process of legislation exposes the experiences of those who have been oppressed, ensuring that this be understood by those who stand with the majority. Often public reason needs to be first shaped through the crucible of campaigns and advocacies within our political forums before it is sharpened for judicial fiat,” ayon sa tribunal.
